Public-Private Partnerships


Our PPP team advises on all aspects of projects of public-private partnerships (PPP). Our team consists of experienced lawyers from our regulatory, corporate and finance and commercial practice groups.

We work closely with our clients, both in the private and public sectors. With our in-depth understanding of these sectors, we can successfully identify opportunities and legal risks and provide innovative solutions all the way through the complex PPP process.

We assist our clients throughout all stages of the project, from reviewing and drafting tender documents, examining the financial agreements, through setting up and structuring special purpose vehicles and drafting and negotiating agreements with the various partners, to following up the implementation of the project contracts. Should a dispute arise, we also have the proven expertise to represent clients in large-scale and complex litigation, both in arbitration procedures and before the courts or the Council of State.

Recent transactions include advising an international building consortium on a large-scale infrastructure project organised by the Flemish public transport company, involving the construction and maintenance of a tunnel and tramline; advising an international building consortium on a PPP project for the construction and maintenance of a large prison complex in the Brussels Region; and advising a local authority organising a tender for a large-scale urban development project including social housing and parking facilities.
