Corporate & Finance Partner Valérie Simonart has contributed to the recently published Liber amicorum Xavier Dieux. In « La responsabilité juridique de l’entreprise en matière de RSE : d’un droit mou à un droit dur », she examines the legal liability – as opposed to the responsibility, within the meaning of awareness and concern for the consequences of one's behaviour - of companies in CSR matters. As CSR traditional instruments (such as voluntary initiatives, recommendations and guidelines, ...) are considered insufficient, she argues that a shift from “soft law” to “hard law” is taking place, as illustrated by the recent Proposal for a Directive of the European Parliament and of the Council on Corporate Sustainability Due Diligence.
