Stand-by time and the right to disconnect


Paul Geerebaert and Loïc Timmermans from our Employment & Benefits practice wrote an article on the hot topics of stand-by time and the right to disconnect.

In this article recently published in the latest issue of Chroniques de droit social, they outline the recent case law of the European Court of Justice on stand-by time and develop a Theory of Constraints whereby they hope to facilitate the understanding of when stand-by time should be classified as working time. Subsequently, they analyse the potential consequences of this case law on the controversial right to disconnect from work.
