Liedekerke successfully assists Reynders Etiketten N.V on an application by Reckitt Benckiser (India) for appointment of an arbitrator on behalf of Reynders Etiketten

Arnaud Nuyts, Bruno Hardy and Estelle Irambona successfully assisted Reynders Etiketten N.V. before the Indian Supreme Court, on an application by Reckitt Benckiser (India) for appointment of an arbitrator on behalf of Reynders Etiketten.
Reynders Etiketten contested being a signatory to the agreement and therefore argued that it was not bound by its arbitration clause.
The Indian Supreme Court sided with Reynders Etiketten and found that “[Reynders Etiketten] was neither the signatory to the arbitration agreement nor did have any causal connection with the process of negotiations preceding the agreement or the
execution thereof”. As a consequence, the Indian Supreme Court refused to appoint an arbitrator on behalf of Reynders Etiketten and dismissed the application.
