Liedekerke assisted Swissport Handling SA in obtaining merger clearance on Swissport Handling's acquisition of its competitor flightcare

The Belgian Competition Council has approved airport handling services company Swissport Handling’s acquisition of Flightcare, subject to commitments in order to meet vertical competition concerns on cargo handling at the Brussels National airport.

The notification procedure, including the contacts with the Belgian competition authority (more in particular with the Auditeur and thereafter with the competition Council) regarding the commitments, were handled by Isabelle Buelens, senior attorney at Liedekerke.
Swissport Handling is part of the Swissport Group, engaged in ground handling services at 177 airports in 36 countries. Swissport Handling acquired control over Flightcare SL, including the latter’s Belgian subsidiary, Flightcare Belgium NV.

Swissport Handling offered commitments in order to meet vertical competition concerns raised by the Competition Authority. One of the commitments will only be maintained if the competing airside supplier is bound by the same or by a further reaching commitment, thus ensuring a level playing field on this market.
The Competition Council cleared the merger in the first phase on 31 August 2012.
