Wealth Structuring & Tax Planning

We have a leading practice in the field of estate planning and advising high net worth individuals and families with respect to all aspects of wealth structuring and inheritance planning.

The practice includes tax and civil law aspects of estate planning, as well as advising on all types of control structures and arrangements. Our practice covers both national and international aspects.

Our clients appreciate our creative, yet practical and sound approach – to even the most complex or sensitive issues. We make sure that we understand our clients’ objectives, anticipate the issues, and tailor our services accordingly, to achieve the best possible result.

Valued by clients for their knowledge, experience and responsiveness, our team of lawyers are widely respected in their fields of expertise. Liedekerke lawyers regularly publish and speak on emerging issues and teach at academic institutions.

With some 20 lawyers, including 5 partners, the team maintains a particularly favourable ratio of partners to associates, ensuring that our clients get the highest-level expertise to achieve their goals.

At the same time, our exacting recruitment criteria ensure that our associates are consistently among the highest calibre law school graduates in the field.

Our lawyers are fluent in English, French and Dutch. Several of them also speak German, Italian or Spanish.

We advise in matters of wealth structuring (property-holding companies, trusts and foundations, retirement plans, shares certification, shareholders agreements, etc.) and inheritance planning (gift duty or inheritance tax, preparation of deeds of gifts or testaments, marriage settlements, transfers of tax residence, etc.). We address all aspects relating to transfers (inter vivos or mortis causa) of private assets and participating interests in companies.

The practice includes assistance in setting-up any type of companies – with or without legal status –, not-for-profit organizations, foundations, investment funds or vehicles, etc., as well under Belgian law as under foreign legislations.

We assist our clients in implementing appropriate management and governance in family undertakings and help them in anticipating and optimizing the transfer to the next generations. In view of structuring the control and the flows of income, we help them in selecting the optimal vehicle, negotiate and elaborate family settlements and/or shareholders’ agreements, etc.

We give advice in relation with the optimization of the holding and/or the transmission of art collections.

We advise individuals, companies and not-for-profit organizations on the tax aspects of their investments (real estate, financial instruments, life-insurance ...).

We assist our clients in regularizing unreported income with the tax authorities (“Service des Décisions Anticipées / Dienst Voorafgaande Beslissingen”).

We give advice on the civil, corporate and tax aspects of ownership and transmission of real estate.

We give advice on the application of double taxation treaties, or the compliance of Belgian domestic law with European directives and regulations. We also act in referring questions to the Court of Justice of the European Union for preliminary rulings.

The prevention and resolution of disputes represent a major portion of the department’s practice. Although first seeking transactional solutions, advocacy practice and hard, seasoned experience in the various fora for the resolution of tax disputes or estate litigation (civil proceedings and, potentially, criminal proceedings ancillary to inheritance disputes) are paramount. Our lawyers appear before all the national courts, including the Court of Cassation and the Constitutional Court.

Our practice includes applying for and negotiating preliminary rulings with the tax authorities.
