Liedekerke secured another litigation success for Uber

Monday 27 February 2017 Liedekerke secured another litigation success for Uber.

In 2015, the Taxi company, Taxi Verts (Brussels), obtained a cease and desist order from the Brussels Commercial Court against UberPop, subject to penalty payments.

Uber effectively stopped UberPop and launched a new service, UberX, in Brussels. UberX drivers are professional drivers licensed under the statute of the care rentals with drivers. On the basis of a broad interpretation of the cease and desist order, Taxi Verts considered this an infringement of the judicial order, and claimed penalty payments before the attachment judge (juge des saisies) in Brussels. Accepting Uber’s defence, the attachment judge considered UberPop and UberX to be two different services and decided that the penalty payments are not due.
